"Heaps Free Student Allowance Promotion"

 

  1. Information on how to enter and prize details set out in all communications regarding Commonwealth Bank of Australia’s Heaps Free Student Allowance Promotion (the “Promotion”) form part of these Conditions of Entry. Any entry not complying with these Conditions of Entry is invalid. Entry into this Promotion and the acceptance or receipt of a prize by the winner or the parent(s) or guardian(s) of the winner is deemed as acceptance of these Conditions of Entry. If the winner is aged under 18 years, the winner’s prize will be awarded to that winner’s parent(s) or guardian(s) on the winner’s behalf.
  2. The Promoter is the Commonwealth Bank of Australia ABN 48 123 123 124 of Level 13, 201 Sussex Street, Sydney NSW 2000, telephone 13 2221 (the “Promoter”).
  3. The Promotion commences at 9.00am (AEDST) on 24 January 2012 and closes at 11.59pm (AEDST) on 30 March 2012 (the “Promotion Period”).
  4. Entry into the Promotion is open to individuals who satisfy the following eligibility requirements (“Eligibility Requirements”):
    1. Applicants must be a full-time or part-time student or apprentice with a valid student ID and currently studying at TAFE or university in Australia during the Promotion Period;
    2. Applicants must not be members of the immediate family of employees of the Promoter or the Promoter’s related entities directly involved in the Promotion (as determined by the Promoter); and
    3. Applicants must obtain parent or guardian consent to enter this Promotion if they are under 18 years of age. In addition, the parent/guardian of the individual must read and consent to these Conditions of Entry. Parents/guardians may be required by the Promoter to enter into a further agreement as evidence of consent to the minor entering this Promotion.
  5. To receive an automatic entry:
    1. individuals who do not have an existing Commonwealth Bank Everyday Account must satisfy the Eligibility Requirements, open a Commonwealth Bank Student Options Package with Everyday Account during the Promotion Period and present their student ID in‐branch at a Commonwealth Bank when they open the Commonwealth Bank Student Options Package with Everyday Account;
    2. individuals who already have an existing Commonwealth Bank Everyday Account must satisfy the Eligibility Requirements and be registered as a student until 11.59pm (AEDST) on 30 March 2012.
  6. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age, place of residence and place of study) and to disqualify any entrant who submits an entry that is not in accordance with these Conditions of Entry or who tampers with the entry process. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
  7. Only one (1) entry permitted per person.
  8. The computerised draw will be conducted by a representative of the Promoter at 3.00pm (AEST) on 12 April 2012 at Commonwealth Bank of Australia Level 13, 201 Sussex Street, Sydney NSW 2000. The winner will be notified in writing within two (2) business days of the draw.
  9. There will be one (1) prize awarded in this Promotion.
  10. The first valid entry drawn will win the prize of a “$12,000 Student Allowance”, which will be awarded as twelve (12) monthly deposits of $1,000 each, into the winner’s Commonwealth Bank Everyday Account at the beginning of each month between May 2012 and April 2013 inclusive.
  11. The total prize pool value is AU$12,000.
  12. By participating in this Promotion, the winner or the winner’s parent(s) or guardian(s) if the winner is aged under 18 years, agrees to the name of the winner being published in the public notices section of The Australian newspaper on 26 April 2012.
  13. The winner accepts the prize ‘as is’ and acknowledges that the Promoter accepts no responsibility for any tax implications that may arise from their prize. The winner should seek advice from the Australian Tax Office or their own taxation adviser or independent financial adviser.
  14. The Promoter’s decision is final and no correspondence will be entered into. The Promoter will arrange for delivery of the prize, after the selection of the winning entry, by mutual agreement with the winner, or the winner’s parent(s) or guardian(s).
  15. In the event that for any reason whatsoever the winner does not take the prize, then the prize will be forfeited by that winner.
  16. The Promoter reserves the right to request that the winner demonstrates their eligibility for the prize as a condition of receipt of the prize. Identification considered suitable for verification is at the discretion of the Promoter.  If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
  17. If the winner fails to claim their prize by 12 July 2012, the Promoter may select further winning entries on 26 July 2012, at the same time and place as the original draw, subject to any written directions given under applicable trade promotion laws and regulations. The winner, if any, will be notified in writing within two (2) business days of the draw.  By participating in this Promotion, the winner or the winner’s parent(s) or guardian(s) if the winner is aged under 18 years, agrees to the name of the winner being published in the public notices section of The Australian newspaper on 9 August 2012.
  18. If for any reason this Promotion is not capable of running as planned (including, but not limited to) infection by computer virus, bugs, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the Promoter which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Promotion, the Promoter may take any action that may be available including cancelling, terminating, modifying or suspending the Promotion, subject to any written directions given under applicable trade promotion laws and regulations.
  19. The Promoter accepts no responsibility for late, lost or misdirected entries. Incomplete, ineligible or incomprehensible entries will be deemed invalid.
  20. Nothing in these Conditions of Entry limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter and its related entities and its and their respective directors, officers, employees and agents, will not be liable for and excludes all liability (including negligence), for any personal injury, loss or damage, whatsoever which is suffered or sustained (including, but not limited to indirect or consequential, financial or other loss) arising in any way out of the promotion.
  21. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees,  the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Conditions of Entry; (e) any tax liability incurred by the winner or an entrant; or (f) use of the prize.
  22. All entries become the sole property of the Promoter. The Promoter collects your personal information so that it may process your entry, administer this Promotion and contact you regarding information on products or services that may be of benefit or interest to you. By entering, each entrant opts in to receive future email and SMS communications from the Promoter. The Promoter may communicate personal information to external providers, organisations to which it may outsource certain functions and to Australian regulatory authorities.   1. Information on how to enter and prize details set out in all communications regarding Commonwealth Bank of Australia’s Heaps Free $1,000 NetBank Promotion (the “Promotion”) form part of these Conditions of Entry. Any entry not complying with these Conditions of Entry is invalid. Entry into this Promotion and the acceptance or receipt of a prize by a winner or the parent(s) or guardian(s) of a winner is deemed as acceptance of these Conditions of Entry. If the winner is aged under 18 years, a winner’s prize will be awarded to that winner’s parent(s) or guardian(s) on the winner’s behalf.
  2. The Promoter is the Commonwealth Bank of Australia ABN 48 123 123 124 of Level 13, 201 Sussex Street, Sydney NSW 2000, telephone 13 2221 (the “Promoter”).
  3. There will be thirty-seven (37) university/TAFE campuses invited to conduct this Promotion on the Promoter’s behalf. Each participating university/TAFE campus will conduct the Promotion during the period commencing no earlier than 9.00am (local time) on 24 January 2012 and ending no later than 3.00pm (local time) on 30 March 2012 on the dates and times advertised at each participating university/TAFE campus (each referred to as a “Promotion Period”). A full list of promotional dates for each participating university/TAFE campus can be accessed on the Promoter’s website at www.commbank.com.au/heapsfree.
  4. Entry into the Promotion is open to individuals who satisfy the following eligibility requirements (“Eligibility Requirements”):
    1. Applicants must be a full-time or part-time student or apprentice with a valid student ID and currently studying at a participating university/TAFE campus in Australia during the Promotion Period; and
    2. Applicants must not be members of the immediate family of employees of the Promoter or the Promoter’s related entities directly involved in the Promotion (as determined by the Promoter).
  5. To be eligible to enter, individuals must satisfy the Eligibility Requirements and during the Promotion Period:
    1. Obtain parent or guardian consent to enter this Promotion if they are under 18 years of age. In addition, the parent/guardian of the individual must read and consent to these Conditions of Entry. Parents/guardians may be required by the Promoter to enter into a further agreement as evidence of consent to the minor entering this Promotion;
    2. Visit the promotional ‘Heaps Free’ stall at their participating University/TAFE campus to participate in the ‘Heaps Free Hunt’ activity;
    3. Register to participate in the ‘Heaps Free Hunt’ activity by either (i) visiting HeapsFree.com.au on their mobile device; or (ii) sending a SMS message with their full name and the name of their University/TAFE campus (in that order, with a space between each item) to 0477222999.
    4. Participate in the ‘Heaps Free Hunt’ activity by following the instructions provided by a promotional staff member to visit, take a photo at a minimum of three (3) of the five (5) checkpoints;
    5. Return to the promotional ‘Heaps Free’ stall at their participating University/TAFE campus and provide evidence (as outlined in clause 6 below) of their participation in the ‘Heaps Free Hunt’ activity to a promotional staff member; and
    6. Provide their requested contact information to a promotional staff member at the ‘Heaps Free’ stall, then collect and retain their ‘Entry Confirmation Ticket’ (which will be referred to at the time of draw).
  6. Individuals must prove that they have participated in the ‘Heaps Free Hunt’ activity by taking a photo and obtaining the unique checkpoint code at each of the three (3) or more checkpoints by one (1) of the following methods:
    •   Sending a MMS message containing the relevant checkpoint photo and the relevant unique checkpoint codeto the Hunt MMS number – 0477222999.
        OR
    •   Sending an SMS message containing the relevant unique checkpoint codeto the Hunt SMS number – 0477222999.
        OR
    •   Showing at least three (3) different check-point photos to a promotional staff at the ‘Heaps Free’ stall at the end of the ‘Heaps Free Hunt’ activity.
  7. The MMS entry mechanism is only open to consumers with an MMS compatible mobile phone connected to a service provider which permits picture messaging to the promotional numbers.  It is recommended that entrants check with their individual service provider before entering via MMS. Entrants under 18 years old must obtain account holder’s consent prior to sending a SMS/MMS. This is not a premium rated service and standard messaging and data rates apply. Entry costs will vary depending on the mobile network used.  The cost of SMS messages will not exceed 55 cents each.  Standard MMS rates apply. Entries are deemed to be received at the time of receipt by the Promoters and NOT at the time of transmission by the entrant.
  8. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age, place of residence and place of study) and to disqualify any entrant who submits an entry that is not in accordance with these Conditions of Entry or who tampers with the entry process (including but not limited to tampering by way of use of techniques designed to avoid the payment of MMS/SMS costs). Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
  9. Only one (1) entry permitted per person.

A draw will take place in each participating University/TAFE campus on the date and time advertised in the participating University/TAFE campus which shall be no later than 3.15pm (local time) on 30 March 2012.  Winners will be notified by phone within two (2) days of the relevant draw and in writing.
  11. There will be one (1) prize awarded per participating University/TAFE campus.
  12. The first valid entry drawn at each participating University/TAFE campus will each win the prize of a “$1,000 deposit into a Commonwealth Bank NetBank Saver Account”, which will be awarded as a one-off deposit of $1,000, into the relevant winner’s Commonwealth Bank NetBank Saver Account. In the event that a winner does not have an existing Commonwealth Bank NetBank Saver Account, the Promoter will contact the winner to set up a Commonwealth Bank NetBank Saver with Everyday Account at a Commonwealth Bank (where the winner must present their valid student ID) and will transfer $1,000 into the winner’s Commonwealth Bank NetBank Saver Account as soon as practicable.
  13. The total prize pool value in each participating University/TAFE campus is AU$1,000.
  14. By participating in this Promotion each winner or a winner’s parent(s) or guardian(s) if the winner is aged under 18 years agrees to the name of the prize winners being published in the public notices section of The Australian newspaper on 12 April 2012.

  20. If for any reason this Promotion is not capable of running as planned (including, but not limited to) infection by computer virus, bugs, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the Promoter which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Promotion, the Promoter may take any action that may be available including cancelling, terminating, modifying or suspending the Promotion, subject to any written directions given under applicable trade promotion laws and regulations.
  21. The Promoter accepts no responsibility for late, lost or misdirected entries. Incomplete, ineligible or incomprehensible entries will be deemed invalid.
  22. When an entrant submits any materials via the promotion including comments, images (including photographs) (“Content”), the entrant, unless the Promoter advises otherwise, licenses and grants the Promoter, its affiliates and sub-licensees a non-exclusive, royalty-free, perpetual, worldwide, irrevocable, and sub-licensable right to use, reproduce, modify, adapt, publish and display such Content for any purpose in any media, without compensation, restriction on use, attribution or liability. Entrants agree not to assert any moral rights in relation to such use and warrant that they have the full authority to grant these rights.

    Entrants agree that they are fully responsible for the Content they submit. The Promoter shall not be liable in any way for such Content to the full extent permitted by law. The Promoter may remove any Content without notice for any reason whatsoever. Entrants warrant and agree that: (a) they will not submit any Content that is unlawful or fraudulent, or that the Promoter may deem in breach of any intellectual property, privacy, publicity or other rights, defamatory, obscene, derogatory, pornographic, sexually inappropriate, violent, abusive, harassing, threatening, objectionable with respect to race, religion, origin or gender, not suitable for children aged under 15, or otherwise unsuitable for publication; (b) they will obtain prior consent from any person or property that appears in their Content; (c) they will obtain full prior consent from any person who has jointly created or has any rights in the Content, to the uses and terms herein; (d) their Content shall not contain viruses or cause injury or harm to any person or entity; and (e) they will comply with all applicable laws and regulations, including without limitation, those governing copyright, content, defamation, privacy, publicity and the access or use of others' computer or communication systems.

    Without limiting any other terms herein, the entrant agrees to indemnify the Promoter for any breach of the above terms.
  23. Entries will not be returned to any entrant. Each entrant warrants to the Promoter that each entry submitted is an original work of the entrant that does not infringe the rights of any third party.  Entrants agree to indemnify the Promoter against all costs and claims by third parties arising from a breach of this warranty.  Entrants consent to any use of their entry which may otherwise infringe their moral rights pursuant to the Copyright Act 1968 (Cth).
  24. By submitting images as part of the ‘Heaps Free Hunt’ activity, each entrant agrees to having their images published on the Promoter’s website(s) and/or other publications.
  25. The Promoter is not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers or providers, computer equipment, software, technical problems or traffic congestion on the internet or any website, or any combination thereof (including, but not limited to) any injury or damage to participants or any other person’s computer related to or related to or resulting from participation in or downloading any materials in this Promotion.
  26.
