Commonwealth Bank of Australia “2016 School Banking Grand Prize” Promotion

  1. Information on how to enter and prize details set out in all communications regarding the Commonwealth Bank of Australia “School Banking Grand Prize” Promotion (the “Promotion”) form part of these Terms and Conditions (“Conditions of Entry”). Any entry not complying with these Conditions of Entry is invalid. Entry into this Promotion and the acceptance or receipt of the prize by the winner is deemed as acceptance of these Conditions of Entry.
  2. The Promoter is the Commonwealth Bank of Australia, ABN 48 123 123 124, of Level 3, 11 Harbour Street, Sydney NSW 2000, telephone: 13 2221 (the “Promoter”).
  3. The Promotion commences at 9am AEDST on 25/01/2016 and closes at 11:59pm AEST on 30/09/2016 (“Promotion Period”).
  4. Entry into the Promotion is only open to individuals who satisfy the following eligibility requirements (“Student Eligibility Requirements”):
    • Individuals must be an Australian resident aged between 5 and 13 years of age at any time during the Promotion Period;
    • Individuals must have parental/guardian approval to enter. Parents/guardians may be required by the Promoter to enter into an agreement as evidence of consent to the minor entering this Promotion;
    • Individuals must have an existing Youthsaver account or open a new Youthsaver account during the Promotion Period, and keep their Youthsaver account open until at least 11:59pm AEDST on 11/10/2016. If the Youthsaver Account is closed before 11:59pm AEDST on 11/10/2016, the individual will be ineligible to win the prize;
    • Individuals must participate in CommBank’s School Banking program;
    • Individuals must not be an employee or a member of the immediate family (spouse, parent, sibling or child) of an employee of the Promoter or the Promoter’s related entities directly involved in the Promotion (as determined by the Promoter).
  5. To enter, individuals must meet the Student Eligibility Requirements and make at least fifteen (15) separate school banking deposits into their Youthsaver account, through the School Banking program, during the Promotion Period. Upon completion of the above, individuals will receive one (1) automatic entry into the draw.
  6. Maximum of one (1) entry per individual applies (i.e. one (1) automatic entry) regardless of the amount of separate school banking deposits made in excess of fifteen (15).
  7. Incomplete entries will be deemed invalid.
  8. To open a Youthsaver account, eligible individuals will require parent/guardian approval. Notwithstanding the above, the Youthsaver account must be opened in the individual’s name in order to be eligible for entry into the Promotion.
  9. The draw will take place at Commonwealth Bank, Level 3, 11 Harbour Street, Sydney NSW 2000 at 12:00pm (noon) AEDST on 11/10/2016. The winner and/or winner’s parent/guardian will be notified in writing and by phone within two (2) business days of the draw. The name and postcode of the winner will be published in the public notices section of The Australian newspaper on 17/10/2016. The Promoter may draw additional reserve entries and record them in order in case an invalid entry or ineligible entrant is drawn, or, if in the case the winner and/or prize recipient wishes to forfeit the prize. 
  10. The first valid entry drawn will win a trip for up to two (2) adults and three (3) children (17 years or under) to Queensland. The trip is valued at up to $13,591 depending on date and point of departure. Prize includes:
    • Up to five (5) x return economy airfares from winner’s nearest Australian capital city airport to either: (a) Sunshine Coast, QLD; or (b) Brisbane, QLD (dependant on flight availability and only provided if winner resides outside of Sunshine Coast, QLD or Brisbane, QLD). If the winner is from either the Sunshine Coast, QLD or Brisbane, QLD, then the prize does not include airfares and the airfare component of the prize is not redeemable for cash. In the event the winner resides outside of the following cities, then return domestic airfares to the closest of these cities will also be provided: Sydney, NSW; Melbourne, VIC; Adelaide, SA; Hobart, TAS; Perth, WA; Darwin, NT; Canberra, ACT or Cairns, QLD;
    • Four (4) nights accommodation at either (i) the Oaks Oasis, Sunshine Coast in a two (2) bedroom villa, with daily breakfast if the prize is taken between 02/01/2017 – 08/01/2017 (exact breakfast menu to be determined by the Promoter); or (ii) a minimum 4* accommodation, in a minimum twin room with daily breakfast, with the exact hotel, room type and breakfast menu to be determined by the Promoter;
    • AU$1,000 spending money, awarded to the winner’s nominated parent/legal guardian on behalf of the winner, in the form of a direct bank transfer to the winner’s nominated parent/legal guardian’s chosen account;
    • Five (5) day car hire of a Kia Carnivale or similar (exact car to be determined by the Promoter); and
    • A one (1) day VIP family Platinum Zoo Adventure tour of the Australia Zoo in QLD which includes a personal guide, animal encounters, morning tea, lunch, afternoon tea and a platinum photography package (exact tour inclusions, menus and photography package to be determined by the Promoter).   11. Spending money, meals, insurance, transport to and from departure point, transfers, items of a personal nature, in-room charges and all other ancillary costs are not included. Prize must be taken by 17/12/2017 and is subject to booking and flight availability. During the entire duration of the prize, a nominated parent/guardian must accompany any person under 18 years of age. The winner and his/her companions are responsible for ensuring that they have valid travel documentation. The winner and his/her companions must depart from and return to the same departure point and travel together. Itinerary to be determined by the Promoter in agreement with the winner’s parent/legal guardian, but in the event that agreement cannot be reached, the Promoter reserves the right to determine the itinerary. Frequent flyer points will not form part of the prize. Prize is subject to the standard terms and conditions of individual prize and service providers. The winner’s parent/legal guardian may be required to present their credit card at time of accommodation check in. Car hire element of the prize must be picked up/dropped off at Brisbane airport or Sunshine Coast airport (whichever is applicable).
  12. If the winner elects to take the prize between 02/01/2017 – 08/01/2017, the prize will also include a meet and greet with Bindi and Robert Irwin, and further include the winner and their companions being accompanied by Bindi and Robert Irwin on part of the winners VIP family Platinum Zoo Adventure tour element of the prize. If the winner elects to take the prize at any time other than during the dates outlined above, then, while Australia Zoo and the Promoter will use reasonable endeavours to arrange for Bindi and Robert Irwin to be available to meet and accompany the winner and his/her companions during part of the VIP family Platinum Zoo Adventure tour element of the prize, this element will be subject to Bindi and Robert Irwin's availability on the relevant dates and is not guaranteed.
  13. In the event of war, terrorism, state of emergency or disaster, the Promoter reserves the right to cancel, terminate, modify or suspend the Promotion or suspend or modify a prize, subject to any written directions from a relevant regulatory authority.
  14. Car hire prize is subject to standard rental conditions. Petrol and insurance is not included. Unlimited kilometres during the five (5) days. The driver must have a current valid driver’s licence issued in an Australian State or Territory and meet any age requirements.
  15. The total prize pool is up to $13,591.
  16. The prize will be awarded to the winner's nominated parent or guardian on the winner’s behalf (“Prize Recipient”). As a condition of accepting a prize, the Prize Recipient must sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.
  17. Subject to the terms and conditions of the participating prize provider(s), if for any reason the winner/Prize Recipient does not take the prize (or an element of the prize) then the prize (or that element of the prize) will be forfeited and will not be redeemable for cash.
  18. If the prize (or any element of the prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that element of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
  19. The prize is not transferable, exchangeable and cannot be taken as cash, unless otherwise specified. The Promoter’s decision is final in relation to all aspects of this Promotion and no correspondence will be entered into.
  20. The winner/Prize Recipient accepts the prize ‘as is’ and acknowledges that the Promoter accepts no responsibility for any tax implications that may arise from the prize. The winner/Prize Recipient should seek advice from the Australian Tax Office or their own taxation adviser or independent financial adviser.
  21. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age, school and place of residence) and reserves the right, in its sole discretion, to disqualify any entrant who the Promoter has reason to believe has submitted an entry that is not in accordance with these Conditions of Entry, tampered with the entry process, has breached any of these Conditions of Entry or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the Promotion. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.
  22. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
  23. A draw for the prize, if unclaimed, may take place on 11/01/2017 at the same time and place as the original draw, subject to any written directions from a regulatory authority. The winner, if any, will be notified in writing within two (2) business days of the draw and their name and postcode will be published in the public notices section of The Australian newspaper on 17/01/2017.
  24. Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this Promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
  25. If for any reason this Promotion is not capable of running as planned (including, but not limited to) infection by computer virus, bugs, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the Promoter which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Promotion, the Promoter may, subject to the approval of all relevant State and Territory Lottery Departments, take any action that may be available including cancelling, terminating, modifying or suspending the Promotion. The Promoter reserves the right, in its sole discretion, to disqualify any individual who tampers with the entry process.
  26. The Promoter is not responsible for any problems or technical malfunction of any lines, servers or providers, software, technical problems or traffic congestion, or any combination thereof (including, but not limited to) any injury or damage to participants or any other person’s computer related to or resulting from participation in or downloading any materials in this Promotion.
  27. Nothing in these Conditions of Entry limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion.
  28. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Conditions of Entry; (e) if the “meet & greet” element of the prize, is delayed, postponed or cancelled for any reason beyond the reasonable control of the Promoter or Australia Zoo; (f) any tax liability incurred by a winner, Prize Recipient or entrant; or (g) use/taking of a prize.
  29. All entries become the sole property of the Promoter. The Promoter collects your personal information so that it may process your entry, administer this Promotion and contact you regarding information on products or services that may be of benefit or interest to you. The Promoter may communicate personal information to external providers and organisations to which it may outsource certain functions, including contactors, prize suppliers, service providers and, as required, to Australian regulatory authorities. The Promoter will also use and handle your personal information as set out in its Privacy Policy, which can be viewed at  The Privacy Policy also contains information about how entrants may opt out, access, update or correct their PI, how entrants may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with. The Promoter will not disclose entrant’s personal information to any entity outside of Australia.
