Commonwealth Bank of Australia “School Banking Prize Lights” Promotion

 

  1. Information on how to enter and prize details set out in all communications regarding the Commonwealth Bank of Australia “School Banking Prize Lights competition” Promotion (the “Promotion”) form part of these Conditions of Entry. Any entry not complying with these Conditions of Entry is invalid. Entry into this Promotion and the acceptance or receipt of a prize by a winner is deemed as acceptance of these Conditions of Entry.
  2. The Promoter is the Commonwealth Bank of Australia, ABN 48 123 123 124, of Level 3, 11 Harbour Street, Sydney NSW 2000, telephone: 13 2221 (the “Promoter”).
  3. The Promotion commences at 9:00am AEST on 11/07/2016 and closes at 11:59pm AEST on 30/09/2016 (“Promotion Period”).

 

Student Element

  1. There are two (2) draws conducted for the purposes of the Student Element, the prize draw (“Star Saver Prize Draw”) and the bonus draw (“Supernova Draw”).
  2. Entry into the Student Element of the Promotion is open to individuals who satisfy the following eligibility requirements (“Student Eligibility Requirements”):
    • Individuals must be an Australian resident aged between 5 and 13 years of age at any time during the Promotion Period;
    • Individuals must have parental/guardian approval to enter and further, the parent/guardian of the individual must read and consent to these Conditions of Entry. Parents/guardians may be required by the Promoter to enter into a further agreement as evidence of consent to the student entering this Promotion;
    • Individuals must have an existing Youthsaver account or open a new Youthsaver account during the Promotion Period, and keep their Youthsaver account open until at least 11:59pm AEDST on 12/10/2016. If the Youthsaver account is closed before 11:59pm AEDST on 12/10/2016, the individual will be ineligible to win a prize.
    • Individuals must participate in CommBank’s School Banking program via the school in which they are currently enrolled;
    • Individuals must not be an employee or a member of immediate family (spouse, parent, sibling or child) of an employee of the Promoter or the Promoter’s related entities directly involved in the Promotion (as determined by the Promoter).
  3. To enter the Star Saver Prize Draw of the Student Element, individuals must satisfy the Student Eligibility Requirements and make at least three (3) separate deposits into their Youthsaver account through the School Banking program at the school at which they are enrolled during the Promotion Period. Upon completion of these steps, individuals will receive one (1) automatic entry into the Star Saver Prize Draw.
  4. To receive one (1) entry into the Supernova Draw, individuals must also complete the following steps during the Promotional Period:
    1. Visit www.commbank.com.au/prizelights, follow the prompts to the entry page to complete the Star Gazing activity as per the instructions; and
    1. Input the requested details including their first name, last name, date of birth, state/territory, parent/guardian’s telephone number and activity answer and submit the fully complete entry form.

For the avoidance of doubt, individuals will not be eligible to receive an entry into the Supernova Draw unless they have made at least three (3) separate deposits into their Youthsaver account through the School Banking program during the Promotion Period, in accordance with clause 6.

  1. There is a maximum of two (2) entries permitted per individual applies for the Student Element (i.e. one automatic entry into the Star Saver Prize Draw, in accordance with Clause 6, and one entry into Supernova Draw, in accordance with Clause 7).
  2. To open a Youthsaver account, eligible individuals will require parent/guardian approval. Notwithstanding the above, the Youthsaver account must be opened in the individual’s name in order to be eligible for entry into the Promotion.
  3. Entries will be divided into the following State/Territory groups: NSW/ACT, VIC, TAS, SA/NT, QLD and WA, based on the individuals State or Territory of residence for the purposes of both the Star Saver Prize Draw and the Supernova Draw. There will be two (2) draws conducted for each State/Territory Group. The computerised draws will take place at Commonwealth Bank, Level 3, 11 Harbour Street, Sydney NSW 2000 at 12:00pm AEDST on 12/10/2016. The winners will be notified in writing and by phone within two (2) business days of the draw. The names and postcodes of Student Prize winners’ (for prizes valued at over $250) from the SA/NT State/Territory group will be published in the public notices section of The Australian newspaper on 19/10/2016. The names and postcodes of Student Prize winners’ from all State/Territory groups will be published online at www.commbank.com.au/prizelights from 19/10/2016. The Promoter may draw additional reserve entries and record them in order in case an invalid entry or ineligible entrant is drawn, or, if in the case the winner and/or Prize Recipient (defined below) wishes to forfeit the prize.
  4. The prizes to be awarded in the Star Saver Prize Draw and the Supernova Draw for each State/Territory group are outlined in the table below. For the purposes of the Star Saver Prize Draw all prizes will be awarded in descending order of value and all prizes will be awarded to the first valid entries drawn in each relevant State/Territory group.

  4. Each Magazine Pack includes 1x 12month subscription to the winner’s choice of magazine from either ‘K-Zone Magazine’ or ‘Total Girl Magazine’.
  5. The total prize pool value for the Student Element nationally is: $62,346.50
  6. Each Student Prize will be awarded to the winner's nominated parent or guardian on the winner’s behalf (“Prize Recipient”). As a condition of accepting a prize, the Prize Recipient must sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.

School Element

  1. Entry into the School Element of the Promotion is open to schools that satisfy the following eligibility requirements (“School Eligibility Requirements”):
  • School must be operating in Australia and participate in the School Banking program; and
  • Schools must have at least one (1) enrolled student who has successfully been entered into the Student Element of this Promotion by the end of the Promotional Period.
  1. Schools that satisfy the School Eligibility Requirements will be awarded one (1) automatic entry into the School Element draw. Limit of one (1) entry per school applies.
  2. Entries will be divided into the following State/Territory groups: NSW/ACT, VIC, TAS, SA/NT, QLD and WA based on the school’s location. There will be one (1) draw conducted for the School Element of this Promotion, for each State/Territory group. The computerised draw will take place at Commonwealth Bank, Level 3, 11 Harbour Street, Sydney NSW 2000 at 12:00pm AEDST on 12/10/2016. The winning schools will be notified in writing and by phone within two (2) business days of the draw. The Promoter may draw additional reserve entries and record them in order in case an invalid entry or ineligible entrant is drawn. The names of winning schools will be announced online at www.commbank.com.au/prizelights from 19/10/2016
  3. Each prize to be won in each State/Territory group consists of a selection of ball sports equipment pack valued at $200 (“School Prize”). Exact balls/equipment to be awarded will be determined by the Promoter in its absolute discretion. The number of prizes to be awarded in the prize draw for each State/Territory group are outlined in the table below. Prizes will be awarded to the relevant number of first valid entries drawn in each relevant State/Territory group:

Total prize value for the School Element nationally is: $15,000. All prizes in the School Element will be awarded to the schools directly.

General

  1. Prizes are subject to the standard terms and conditions of individual prize and service providers.
  2. Subject to the terms and conditions of the participating prize provider(s), if for any reason a winner/Prize Recipient/school does not take a prize (or an element of the prize) at the time stipulated, then the prize (or that element of the prize) will be forfeited and will not be redeemable for cash.
  3. If any prize (or any element of a prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that element of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
  4. The total prize pool for each state/territory for both the School Element and Student Element prizes is as follows: NSW/ACT $25,173.48, VIC $15,469.30, TAS $4,395.29, SA/NT $4,095.39, QLD $20,264.39 and WA $7,848.65.
  5. Prizes are not transferable, exchangeable and cannot be taken as cash, unless otherwise specified. The Promoter’s decision is final in relation to all aspects of this Promotion and no correspondence will be entered into.
  6. The winners/Prize Recipients/schools accept the prize ‘as is’ and acknowledges that the Promoter accepts no responsibility for any tax implications that may arise from their prize. The winners/Prize Recipients/schools should seek advice from the Australian Tax Office or their own taxation adviser or independent financial adviser.
  7. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Conditions of Entry, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the promotion. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.
  8. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
  9. A draw(s) for any prizes in either the Student Element or the School Element, if unclaimed, may take place on 07/02/2017 at the same time and place as the original draws, subject to any written directions from a regulatory authority. The winners, if any, will be notified in writing within two (2) business days of the draw. The names and postcodes of Student Prize winners’ (for prizes valued at over $250) from the SA/NT State/Territory group will be published in the public notices section of The Australian newspaper on 14/02/2017. The names and postcodes of Student Prize winners’ from all other State/Territory groups will be published online at www.commbank.com.au/prizelights from 14/02/2017. The names of winning schools from the School Element will be announced online at www.commbank.com.au/prizelights from 14/02/2017.
  10. Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this Promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
  11. If for any reason this Promotion is not capable of running as planned (including, but not limited to) infection by computer virus, bugs, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the Promoter which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Promotion, the Promoter may, subject to the approval of all relevant State and Territory Lottery Departments, take any action that may be available including cancelling, terminating, modifying or suspending the Promotion. The Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process.
  12. The Promoter is not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers or providers, computer equipment, software, technical problems or traffic congestion on the internet or any website, or any combination thereof (including, but not limited to) any injury or damage to participants or any other person’s computer related to or related to or resulting from participation in or downloading any materials in this Promotion.
  13. Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used.
  14. Nothing in these Conditions of Entry limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion.
  15. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Conditions of Entry; (e) any tax liability incurred by a winner, Prize Recipient, school or entrant; or (f) use/taking of a prize.
  16. All entries become the sole property of the Promoter. The Promoter collects your personal information so that it may process your entry, administer this Promotion and contact you regarding information on products or services that may be of benefit or interest to you. The Promoter may communicate personal information to external providers and organisations to which it may outsource certain functions, including contactors, prize suppliers, service providers and, as required, to Australian regulatory authorities. The Promoter will also use and handle your personal information as set out in its Privacy Policy, which can be viewed at www.commbank.com.au.  The Privacy Policy also contains information about how entrants may opt out, access, update or correct their PI, how entrants may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with. The Promoter will not disclose entrant’s personal information to any entity outside of Australia. You may also access and correct your information by contacting the Privacy Officer, Customer Relations, Commonwealth Bank Group, Reply Paid 41, NSW 2001, by calling the Promoter on 13 2221 or by visiting any branch of the Promoter.   17. These Conditions of Entry shall be governed by the laws of Australia and each entrant agrees to submit to the non-exclusive jurisdiction of Australia.
