Commonwealth Bank of Australia “Youthsaver Prize Lights” Promotion

  1. Information on how to enter and prize details set out in all communications regarding the Commonwealth Bank of Australia “Youthsaver Prize Lights competition” Promotion (the “Promotion”) form part of these Conditions of Entry. Any entry not complying with these Conditions of Entry is invalid. Entry into this Promotion and the acceptance or receipt of a prize by a winner is deemed as acceptance of these Conditions of Entry.
  2. The Promoter is the Commonwealth Bank of Australia, ABN 48 123 123 124, of Level 3, 11 Harbour Street, Sydney NSW 2000, telephone: 13 2221 (the “Promoter”).
  3. The Promotion commences at 9:00am AEST on 11/07/2016 and closes at 11:59pm AEST on 30/09/2016 (“Promotion Period”).
  4. Entry into the Promotion is open to individuals who satisfy the following eligibility requirements (“Eligibility Requirements”): 
    • Individuals must be an Australian resident aged between 5 and 13 years of age at any time during the Promotion Period;
    • Individuals must have parental/guardian approval to enter and further, the parent/guardian of the individual must read and consent to these Conditions of Entry. Parents/guardians may be required by the Promoter to enter into a further agreement as evidence of consent to the student entering this Promotion;
    • Individuals must have a Youthsaver account during the Promotion Period, and keep their Youthsaver account open until at least 11:59pm AEDST on 12/10/2016. If the Youthsaver account is closed before 11:59pm AEDST on 12/10/2016, the individual will be ineligible to win a prize.
    • Individuals must not be participating in CommBank’s School Banking program via the school in which they are enrolled during the Promotional Period; and
    • Individuals must not be an employee or a member of immediate family (spouse, parent, sibling or child) of an employee of the Promoter or the Promoter’s related entities directly involved in the Promotion (as determined by the Promoter).
  5. To receive one (1) entry into the draw, individuals must satisfy the Eligibility Requirements and complete the following steps during the Promotional Period:
    1. Make at least three (3) separate deposits into their Youthsaver account;  
    2. Visit, follow the prompts to the entry page to complete the Star Gazing activity as per the instructions; and
    3. Input the requested details including their first name, last name, date of birth, state/territory, parent/guardian’s telephone number and activity answer and submit the fully complete entry form.

For the avoidance of doubt, individuals will not be eligible to receive an entry into the draw unless they have made at least three (3) separate deposits into their Youthsaver account.

  1. There is a maximum of one (1) entry permitted per individual.
  2. To open a Youthsaver account, eligible individuals will require parent/guardian approval. Notwithstanding the above, the Youthsaver account must be opened in the individual’s name in order to be eligible for entry into the Promotion.
  3. The computerised draw will take place at Commonwealth Bank, Level 3C, 11 Harbour Street, Sydney NSW 2000 at 12:00pm AEDST on 12/10/2016. The winners will be notified in writing and by phone within two (2) business days of the draw. The names and postcodes of any winners will be published online at from 19/10/2016. The Promoter may draw additional reserve entries and record them in order in case an invalid entry or ineligible entrant is drawn, or, if in the case the winner and/or Prize Recipient (defined below) wishes to forfeit the prize. 
  4. The first fifty (50) valid entries drawn will each win a PlayStation 4 Pack valued at $607 which includes one (1) PlayStation 4 (white) 500GB console with wireless controller, one (1) Just Dance 2016 game and one (1) FIFA 2016 game.
  5. The total prize pool value is $30,350.
  6. Each prize will be awarded to the winner's nominated parent or guardian on the winner’s behalf (“Prize Recipient”). As a condition of accepting a prize, the Prize Recipient must sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.
  7. Prizes are subject to the standard terms and conditions of individual prize and service providers.
  8. Subject to the terms and conditions of the participating prize provider(s), if for any reason a winner/Prize Recipient does not take a prize (or an element of the prize) at the time stipulated, then the prize (or that element of the prize) will be forfeited and will not be redeemable for cash.
  9. If any prize (or any element of a prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that element of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
  10. Prizes are not transferable, exchangeable and cannot be taken as cash, unless otherwise specified. The Promoter’s decision is final in relation to all aspects of this Promotion and no correspondence will be entered into.
  11. The winners/Prize Recipients accept the prize ‘as is’ and acknowledges that the Promoter accepts no responsibility for any tax implications that may arise from their prize. The winners/Prize Recipients should seek advice from the Australian Tax Office or their own taxation adviser or independent financial adviser.
  12. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Conditions of Entry, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the promotion. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.
  13. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
  14. A draw for any prizes if unclaimed may take place on 07/02/2017 at the same time and place as the original draws, subject to any written directions from a regulatory authority. The winners, if any, will be notified in writing within two (2) business days of the draw. The names and postcodes of any winners will be published online at from 14/02/2017.
  15. Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this Promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
  16. If for any reason this Promotion is not capable of running as planned (including, but not limited to) infection by computer virus, bugs, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the Promoter which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Promotion, the Promoter may, subject to the approval of all relevant State and Territory Lottery Departments, take any action that may be available including cancelling, terminating, modifying or suspending the Promotion. The Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process.
  17. The Promoter is not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers or providers, computer equipment, software, technical problems or traffic congestion on the internet or any website, or any combination thereof (including, but not limited to) any injury or damage to participants or any other person’s computer related to or related to or resulting from participation in or downloading any materials in this Promotion.
  18. Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used.
  19. Nothing in these Conditions of Entry limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion.
  20. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Conditions of Entry; (e) any tax liability incurred by a winner, Prize Recipient, or entrant; or (f) use/taking of a prize.
  21. All entries become the sole property of the Promoter. The Promoter collects your personal information so that it may process your entry, administer this Promotion and contact you regarding information on products or services that may be of benefit or interest to you. The Promoter may communicate personal information to external providers and organisations to which it may outsource certain functions, including contactors, prize suppliers, service providers and, as required, to Australian regulatory authorities. The Promoter will also use and handle your personal information as set out in its Privacy Policy, which can be viewed at  The Privacy Policy also contains information about how entrants may opt out, access, update or correct their PI, how entrants may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with. The Promoter will not disclose entrant’s personal information to any entity outside of Australia.   22. These Conditions of Entry shall be governed by the laws of Australia and each entrant agrees to submit to the non-exclusive jurisdiction of Australia.
