Commonwealth Bank “Future Savers Grand Prize” Promotion

  1. Information on how to enter and prize details set out in all communications regarding the Commonwealth Bank of Australia Commonwealth Bank “Future Savers Grand Prize” Promotion (the “Promotion”) form part of these Conditions of Entry. Any entry not complying with these Conditions of Entry is invalid. Entry into this Promotion and the acceptance or receipt of any prize is deemed as acceptance of these Conditions of Entry.
  2. The promoter is the Commonwealth Bank of Australia, ABN 48 123 123 124, of Level 3C, 11 Harbour Street, Sydney NSW 2000, telephone: 13 2221 (the “Promoter”).
  3. The Promotion commences on 23/01/2017 and closes at 11:59pm AEST on 29/09/2017 (the “Promotion Period”).
  4. Entry into the Promotion is open to individuals who satisfy the following eligibility requirements (“Eligibility Requirements”):
    • Individuals must be Australian residents who: (a) are aged between 4-13 years; (b) have a Commonwealth Bank Youthsaver account; and (c) are participating in the Commonwealth Bank’s ‘School Banking program’ during the Promotional Period;
    • Individuals must keep their Youthsaver account open until the date of the draw to be eligible to win a prize;
    • Individuals must have parental/guardian approval to enter the Promotion. The parent/guardian of the entrant must read and consent to these Conditions of Entry. Parents/guardians may be required by the Promoter to enter into a further agreement as evidence of consent to the minor entering this promotion; and
    • Individuals must not be a member of immediate family (spouse, parent, sibling or child) of an employee of the Promoter or the Promoter’s related entities directly involved in the Promotion (as determined by the Promoter).
  5. To receive one (1) automatic entry, eligible individuals must make a minimum of fifteen (15) deposits (of any value) through the School Banking program into their Commonwealth Bank Youthsaver account during the Promotion Period (“Qualifying Deposit”).
  6. Should an individual not wish to receive an automatic entry into the Promotion, they should contact the Promoter at Youth & School Banking, Consumer Marketing, Commonwealth Bank Place, Level 3C, 11 Harbour Street, Sydney, NSW, 2000.
  7. Only one (1) entry permitted per person.
  8. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
  9. There will be one (1) computerised draw conducted for all entries received during the Promotional Period. The draw will take place at Commonwealth Bank Place, Level 3, 11 Harbour Street, Sydney, NSW 2000 at 12:00pm AEDST on 11/10/2017. The Promoter may draw additional reserve entries and record them in order in case an invalid entry or ineligible entrant is drawn.
  10. The winner will be notified in writing and by telephone within two (2) business days of the draw and their name will also be published in The Australian on 17/10/2017.
  11. The first valid entry drawn will win a trip for two (2) adults and three (3) children (13 years or under) to Tokyo, Japan valued at up to AU$22,855 depending on date and point of departure.  Prize includes:
    • return economy airfares from the winner’s nearest Australian capital city to Tokyo, Japan (via Sydney, NSW) for two (2) adults and three (3) children;
    • five (5) nights accommodation in two (2) double rooms at the Sheraton Grande Tokyo Bay Hotel in Tokyo for two (2) adults and three (3) children;
    • AU$1,000 spending money for the winner, awarded in the form of a direct deposit into the winner’s Youthsaver account; and 3-day Magic Passport tickets to Tokyo Disneyland and Tokyo DisneySea for two (2) adults and three (3) children.
  12. Additional spending money, meals, taxes (excluding airline and airport taxes), insurance, passports, visas, vaccinations, transport to and from departure point, transfers, items of a personal nature, in-room charges and all other ancillary costs are not included. Prize must be taken by 01/12/2018 and is subject to booking and flight availability. During the entire duration of the prize, a nominated parent/guardian must accompany any person under 18 years of age. The winner and his/her companions are responsible for ensuring that they have valid passports, and any requisite visas, vaccinations and travel documentation. The winner and his/her companions must depart from and return to the same departure point and travel together. Itinerary to be determined by the Promoter in agreement with the winner but in the event that agreement cannot be reached, the Promoter reserves the right to determine the itinerary. Frequent flyer points will not form part of the prize. Prize is subject to the standard terms and conditions of individual prize and service providers. An adult may be required to present their credit card at time of accommodation check in.
  13. The prize will be awarded to the winner's nominated parent or guardian on the winner’s behalf.
  14. In the event that the winner’s Youthsaver account is closed before 12:00pm AEDST on 11/10/2017 they will be deemed to have forfeited their right to receive the prize.
  15. Total prize pool value is up to AU$22,855.
  16. All prize values stated in the Terms and Conditions are accurate as at 24/08/2016.
  17. Subject to the unclaimed prize draw clause, if for any reason the winner does not take a prize (or part of the prize) by the time stipulated by the Promoter, then the prize (or that part of the prize) will be forfeited.
  18. If the prize (or part of the prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
  19. The prize, or any unused portion of the prize, is not transferable or exchangeable and cannot be taken as cash, unless specified otherwise.
  20. The Promoter’s decision is final and no correspondence will be entered into.
  21. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the promotion. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.
  22. A draw for the prize, if unclaimed, may take place on 17/01/2018 at the same time and place as the original draws, subject to any written directions from a regulatory authority. In the case of a winner, they will be notified in writing and by telephone within two (2) business days of the re-draw and their name (will also be published in The Australian on 19/01/2018.
  23. Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this Promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
  24. If for any reason this Promotion is not capable of running as planned, including, but not limited due to infection by computer virus, bugs, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the Promoter which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Promotion, the Promoter may, subject to the approval of all relevant State and Territory Lottery Departments, take any action that may be available including cancelling, terminating, modifying or suspending the Promotion. The Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process.
  25. The Promoter is not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers or providers, computer equipment, software, technical problems or traffic congestion on the internet or any website, or any combination thereof (including, but not limited to) any injury or damage to participants or any other person’s computer related to or related to or resulting from participation in or downloading any materials in this Promotion.
  26. Nothing in these Conditions of Entry limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion.
  27. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Conditions of Entry; (e) any tax liability incurred by a winner or entrant; or (f) taking and/or use of the prize.
  28. As a condition of accepting the prize, the winner’s nominated parent/legal guardian, on behalf of the winner (and each of the winner’s companions) must sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.  In the event a winner’s companion is under the age of 18, a nominated parent/legal guardian of such person will be required to sign the legal documentation required under this clause on their behalf.
  29. All entries become the sole property of the Promoter. The Promoter collects your personal information so that it may process your entry, administer this Promotion and contact you regarding information on products or services that may be of benefit or interest to you. The Promoter may communicate personal information to external providers and organisations to which it may outsource certain functions, including contactors, prize suppliers, service providers and, as required, to Australian regulatory authorities. The Promoter will also use and handle your personal information as set out in its Privacy Policy, which can be viewed at www.commbank.com.au. The Privacy Policy also contains information about how entrants may opt out, access, update or correct their PI, how entrants may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with. The Promoter may disclose entrant’s personal information overseas from time to time (see Promoter’s Privacy Policy for details). You may also access and correct your information by contacting the Privacy Officer, Customer Relations, Commonwealth Bank Group, Reply Paid 41, NSW 2001, by calling the Promoter on 13 2221 or by visiting any branch of the Promoter.   30. These Conditions of Entry shall be governed by the laws of Australia and each entrant agrees to submit to the non-exclusive jurisdiction of Australia.
