Conditions of Entry

  1. Information on how to enter and prize details set out in all communications regarding the Commonwealth Bank of Australia “Commbank Graduate & Summer Intern 2015 Promotion” (the “Promotion”) form part of these Conditions of Entry. Any entry not complying with these Conditions of Entry is invalid. Entry into this Promotion and the acceptance or receipt of a prize by a winner or the parent(s) or guardian(s) of a winner is deemed as acceptance of these Conditions of Entry. If a winner is under the age of 18 years, the winner’s prize will be awarded to that winner’s parent(s) or guardian(s) on the winner’s behalf.
  2. The Promoter is the Commonwealth Bank of Australia, ABN 48 123 123 124, of 201 Sussex Street, Sydney NSW 2000, telephone 13 22 21 (the “Promoter”).
  3. The Promotion commences at 9am AEST on 23/02/2015 and closes at 5pm AEDST on 27/03/2015 (the “Promotion Period”).
  4. Entry into the Promotion is open to individuals who satisfy the following eligibility requirements (“Eligibility Requirements”):
    • Are an Australian or New Zealand permanent resident or citizen;
    • Are completing or are enrolled in a university degree in the year 2015, at a university located in Australia or New Zealand
    • Are not an employee of the Promoter or the Promoter’s related entities directly involved in the Promotion (as determined by the Promoter);
    • Are not a member of the immediate family (spouse, parent, sibling or child) of employees of the Promoter or the Promoter’s related entities directly involved in the Promotion (as determined by the Promoter); and
    • Have not already entered the Promotion.

    Entrants under 18 years old must have parental/guardian approval to enter and further, the parent/guardian of the entrant must read and consent to these Conditions of Entry. Parents/guardians may be required by the Promoter to enter into a further agreement as evidence of consent to the minor entering this Promotion.
  5. During the Promotional Period the Promoter will display advertising material about the Promotion, including but not limited to at selected universities in Australia and at selected websites. The exact location of each piece of advertising material will be determined by the Promoter in its absolute discretion. Each piece of advertising material will contain one (1) of four (4) promotional questions and a unique URL correlating to the featured question. To enter, individuals must satisfy the Eligibility Requirements and during the Promotion Period:
    • Visit the URL featured on the relevant piece of Promotion advertising material. Individuals can visit the URL by typing in the relevant address into their browser or by scanning a QR code featured on the advertising material with an eligible device;
    • Follow the prompts to access the promotion entry page;
    • Provide a correct answer to the promotional question featured on the entry page (which will correspond to the URL used), and if the answer provided is correct, follow the prompts on screen to provide all of the requested details (including first and last name, valid contact phone number, valid email address, what university they are completing their degree at, the type of degree they are completing and the year when they expect to complete their university degree); and
    • Agree to and accept the Conditions of Entry and submit the fully completed entry form.
    Individuals must provide a correct answer to the promotional question on screen to be able to enter the draw. If an individual fails to answer one (1) featured promotional question correctly, they will be given the opportunity (by following the prompts on screen) to attempt to answer another promotional question(s) correctly in order to gain an entry into the draw.
  6. Only one (1) entry is permitted per person.
  7. The computerised draw will be conducted by Anisimoff Legal, Level 5, 492 St Kilda Road, Melbourne VIC 3004 at 11am AEDST on 02/04/2015. Winner will be notified by email within two (2) business days of the draw, and their name will be published at https://www.commbank.com.au/about-us/careers/graduate-recruitment-program/winner.html from 09/04/2015.
  8. There will be one (1) prize, which will be awarded to the first valid entry drawn in the draw. The prize is a 13-inch MacBook Air (256GB, Silver) valued at RRP $1,399.00.
  9. The total prize value is $1,399.00, based on the recommended retail value provided by the supplier and is correct at the time of printing. The Promoter accepts no responsibility for any variation in prize value.
  10. By acceptance or receipt of a prize by a winner or a winner’s parent(s) or guardian(s), the winner or their parent(s) or guardian(s), as applicable, agree to the name of the winner being published, as specified in these Conditions of Entry.
  11. The prize is not transferable or exchangeable and cannot be taken as cash. The winner accepts the prize ‘as is’ and acknowledge that the Promoter accepts no responsibility for any tax implications that may arise from the prize. The winner should seek advice from the Australian Tax Office or their own taxation adviser or independent financial adviser.
  12. The Promoter’s decision is final in relation to all aspects of the Promotion and no correspondence will be entered into. The Promoter will arrange for delivery of the prize within Australia, after the selection of the winning entry, by mutual agreement with the winner, or the winner’s parent(s) or guardian(s).
  13. The Promoter will use its best endeavours to provide the prize listed. If the prize is unavailable for whatever reason, the Promoter reserves the right to substitute the prize for a prize or item of an equivalent value, subject to any written directions given under applicable trade promotion laws and regulations.
  14. Subject to the unclaimed prize draw clause, in the event that for any reason whatsoever a winner does not take the prize at the time specified by the Promoter, then the prize will be forfeited and cash will not be awarded in lieu of that element of the prize.
  15. The Promoter reserves the right to request that the winner demonstrates their eligibility for the prize as a condition of receipt of a prize. Identification considered suitable for verification is at the discretion of the Promoter.
  16. If the winner fails to claim their prize by 03/07/2015 the Promoter may select further winning entries on that date (at the same time and place as the original draw) subject to any written directions given under applicable trade promotion laws and regulations. Winner, if any, will be notified by email within two (2) business days of the draw, and their name will be published at  https://www.commbank.com.au/about-us/careers/graduate-recruitment-program/winner.html from 10/07/2015.
  17. If for any reason this Promotion is not capable of running as planned (including, but not limited due to infection by computer virus, bugs, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the Promoter which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Promotion), the Promoter may take any action that may be available including cancelling, terminating, modifying or suspending the Promotion, subject to approval by the relevant regulatory authorities. The Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process.
  18. Any cost associated with accessing the promotional URLs is dependent on the Internet Service Provider used and is the responsibility of the entrant.
  19. The Promoter accepts no responsibility for late, lost or misdirected entries. Incorrect, Incomplete, ineligible or incomprehensible entries will be deemed invalid. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who the Promoter has reason to believe has breached any of these Conditions of Entry, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the promotion. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.
  20. The Promoter is not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers or providers, computer equipment, software, technical problems or traffic congestion on the internet or any website, or any combination thereof (including, but not limited to) any injury or damage to participants or any other person’s computer related to or related to or resulting from participation in or downloading any materials in this Promotion.
  21. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
  22. Nothing in these Conditions of Entry limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia and in New Zealand (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion.
  23. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any tax liability incurred by a winner or entrant; or (e) taking of/use of a prize.
  24. Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this Promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
  25. As a condition of accepting the prize, the winner (or their parent(s)/guardian(s) if the winner is under the age of 18 years) must sign any legal documentation as and in the form required by the Promoter in its absolute discretion, including but not limited to a legal release and indemnity form.
  26. All entries become the sole property of the Promoter. The Promoter collects personal information so that it may process entries, administer this Promotion and contact entrants regarding information on products or services that may be of benefit or interest to them. Entry is conditional on providing this information. Entrants may access and correct their information by contacting the Privacy Officer, Customer Relations, Commonwealth Bank Group, Reply Paid 41, NSW 2001, by calling the Promoter on 13 2221 or by visiting any branch of the Promoter. The Promoter will also use and handle personal information as set out in its Privacy Policy, available at www.commbank.com.au or on request from any Commonwealth Bank branch. The Privacy Policy also contains information about how entrants may access, update or correct their personal information, how entrants may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with.   27. The laws of Australia apply to this promotion to the exclusion of any other law.  Entrants submit to the exclusive jurisdiction of the courts of Australia.
